How criminal proceedings work

A criminal case moves through named stages, and each one opens and closes options. This is the order in which they come.

Complaint or querella

Proceedings begin with a complaint or a querella. We prepare and file it, or, if it has been brought against you, we take over the defence from the outset.

Investigation

The investigating court gathers evidence, takes statements and decides whether the case goes to trial. This is where the defence is built, and it conditions everything that follows.

Trial

The case is heard before the court with jurisdiction over it. We put forward the evidence, examine the witnesses and argue your position at the hearing.

Appeals

The judgment can be reviewed by a higher court. We assess the grounds, explain your real options and lodge the appeal in time.

I have been arrested or summoned to give a statement

This is when having a lawyer counts for most. What you say in a first statement stays in the file and shapes the whole defence that follows. Call us before you make any statement: two minutes on the phone are worth more than an improvised account.

  • You have the right to a lawyer from the very first moment, at the police station too, and to speak with them in private before making a statement.
  • You have the right not to make a statement and not to incriminate yourself. Exercising it is legitimate and cannot be held against you.
  • If you have received a summons, bring it to the office exactly as it is: it states the court, the date and your position in the proceedings.
  • Do not sign anything you do not understand and do not give an account of the facts before discussing it with your lawyer.
